Participation in a Tablemouvant tour or using any service provided by Tablemouvant requires the acceptance or the below liability waiver which is legally binding. All travelers must review and acknowledge this waiver prior to the trip's departure.
By participating in a Tablemouvant tour, I acknowledge and voluntarily accept that my itinerary may involve a range of activities (“Activities”), including but not limited to: guided tours, cultural experiences, tastings, classes, walking or hiking excursions, swimming in natural bodies of water, wildlife observation, and other outdoor or physical experiences. I understand this list is illustrative, not exhaustive, and that additional activities may be available, some of which I may choose to engage in.
I further acknowledge that trip facilitators, guides, and instructors must make real-time judgments regarding weather, terrain, safety, and group dynamics and that such judgment, while well-intentioned, may not always prevent harm. I fully accept that risk is an unavoidable part of travel of this nature and that these risks cannot be eliminated without fundamentally altering the nature of the experience.
I willingly and knowingly assume all risk, both known and unknow, associated with my participation in the Tour and accept full responsibility for my personal safety and well-being throughout its duration.
I confirm that I am physically and medically fit to participate in the Tour and its associated Activities. I either have sufficient insurance coverage to cover potential injury, illness, or damage arising from the Tour, or I accept full financial responsibility for any medical expenses or losses incurred as a result of my participation. If I have any medical conditions that may affect my ability to safely participate, I accept the risks involved and the consequences that may arise.
To the fullest extent permitted by applicable law, I, the undersigned traveler (or, if applicable, as the parent or legal guardian of a participating minor), on behalf of myself, my heirs, legal and personal representatives, next of kin, and assigns (collectively, “Releasors”), hereby expressly and irrevocably:
- Release, waive, discharge, and hold harmless Tablemouvant, including its officers, directors, employees, shareholders, agents, affiliates, local operators, guides, volunteers, and any related parties (collectively, “Released Parties”) from any and all liability, claims, damages, losses, demands, or causes of action that may arise out of or relate to my participation in the Tour—whether arising from the negligence of the Released Parties or otherwise;
- Agree not to initiate any legal action or claim against the Released Parties for any such liabilities; and accept full financial responsibility for any claims brought against Tablemouvant or its affiliates by a third party as a result of my actions, omissions, or misconduct during the Tour, and agree to indemnify and defend the Released Parties from any related legal expenses or settlements, including reasonable attorney’s fees.
I understand and intend that this agreement serves as a complete release and assumption of risk not only for myself but also for family members, dependents, or minors traveling with me or on whose behalf I am signing. I affirm that I am acting voluntarily, with a full understanding of the risks involved, and that I intend this agreement to be legally binding upon me, my estate and my successors.
